Stemette Futures Terms and Conditions – London Landmarks Half Marathon Charity Places

  • What’s in These Terms and Conditions?

These terms and conditions (the “Terms”) tell you the rules relating to your participation in London Landmarks Half Marathon in support of Stemette Futures (the “Event”). By registering for the Event, you agree to the below terms and conditions.

You, as the participant, acknowledge that the Event is organised by a third party – London Landmarks Half Marathon, Nicholas House, 3 Laurence Pountney Hill, London, England, EC4R 0BB (the Organiser”). You acknowledge that you have a separate agreement with the Organiser and that its own terms and conditions should be read in conjunction with these Terms.

  • Who We Are and How to Contact Us

STEMETTE FUTURES (“Stemette Futures, we, us, our”) are registered in England and Wales under company number CE021302 and have our registered office and trading address at 35 New Broad Street, London, EC2M 1NH.

  • Your Personal Data

Your personal data will be processed in accordance with our Privacy Policy. You acknowledge that we will share your contact details with the Organiser of the Event and, where necessary, with other third parties involved in the administration of the Event. We will never share your data with any other third parties without informing you and, where required, your consent.

  • Marketing and Promotional Content

You acknowledge and consent to our use of any photographs, videos or other images in which you appear which have been taken at the Event, for promotional and marketing purposes during or after the Event and in relation to any future Stemette Futures events.

You agree that Stemette Futures will retain the intellectual property rights for all media taken or produced by Stemette Futures or any associated parties, to the extent permitted by law. The marketing and promotional purposes for which we may use this media may include, but are not limited to, promotion on Stemette Futures’ and third-party websites, social media, in online and print media publications and other marketing materials.

If you do not wish for your images to be used in this way, please contact our team using the following email address: kat@stemettefutures.org.

We have no control over the Organiser’s use of any images in which you may appear.

  • Registration

You acknowledge that we have a limited number of spaces and cannot guarantee that your application will be successful.

You acknowledge that we may contact you, either electronically or in writing, through email, telephone calls, SMS or post, from time to time regarding the Event.

We may need to contact you for necessary administrative and Event-related purposes. If you fail to respond to any communications sent by us requesting additional details from you, or if you fail to complete requested actions which are necessary for your registration, you acknowledge that your place in the Event may be put at risk.

You acknowledge that you may be required to independently register your contact details or any additional details required with the Organiser. If required, registering these details will be your sole responsibility. Failure to do so, may prevent you from participating in the Event. We will use reasonable endeavours to inform you of any such obligations towards the Organiser in advance.

  • Registration Fees

You acknowledge the registration fee you have paid is non-refundable, non-transferrable, and cannot be used towards your sponsorship pledge.

You acknowledge that if your place is deferred to the following year, you may be required to pay the registration fee again.

  • Fundraising 

You acknowledge your place in the Event is conditional upon your fundraising efforts and you agree to raise the minimum sponsorship pledge as stated on our application form, exclusive of any Gift Aid. Donations that you, or your sponsors, make to Stemette Futures cannot be refunded, except under the limited circumstances permitted by law or provided for in Charity Commission guidance. Donations will not be refunded if you withdraw from, or do not participate in, the Event.

In the course of any fundraising efforts made by yourself or by others on your behalf, you agree to make it clear that these efforts are conducted ‘in aid’ of Stemette Futures and not to represent that these efforts are ‘on behalf of’ Stemette Futures.

When fundraising, you agree to act lawfully at all times. You must not put undue pressure on any party or individual to sponsor you to the extent that it contravenes any legislation in force in England and Wales. You also agree not to act in any way that will cause detriment to Stemette Futures’ reputation or is contrary to our values, and you will comply with any fundraising guidance provided by Stemette Futures.

You agree to send all sponsorship funds collected or raised to us no later than six weeks after the Event. If your receipt of sponsorship money was conditional upon your completion of the Event and you do not complete the Event, you must subsequently contact donors and ask if they are still happy for sponsorship monies to be provided to Stemette Futures, where possible. If any donor(s) do not provide consent for their donation to be passed to Stemette Futures, you must refund the monies. This term also applies if the Event is cancelled by the Organiser. There is no obligation to pay any withdrawn donations to Stemette Futures in this instance, provided that you have exceeded the minimum sponsorship pledge (as stated in our application form for the Event). This term does not apply to donations made without any further conditions.

All donations must be made through an online giving platform, such as JustGiving. Alternatively, donations can be made via a cheque, made payable to ‘Stemette Futures’ and sent to 35 New Broad Street, London, EC2M 1NH, or through a bank transfer to Stemette Futures: Sort code – 23-05-80, Account number – 37948667, provided that you make clear that the donations relate to you so that we can keep track of your progress.

If you wish to use our logos or other trademarks for the purposes of any fundraising efforts or during the Event, please contact us and we can provide branded materials for use in connection with any fundraising activities.

  • Participation

You acknowledge that you are freely entering into the Event at your own risk and that you are of sufficient physical and mental fitness to do so. If you have a medical condition, whether mental or physical, or you are unsure of your ability to take part in the Event, you agree to seek medical advice from a general practitioner prior to participating in the Event.

The Event is both physically and mentally challenging. It may therefore pose a risk of discomfort, illness, injury, and even death. You acknowledge that, in participating in the Event, you are satisfied that you are physically capable of doing so without undue risk to your health or life. We do not conduct medical checks on participants and it is your sole responsibility to ensure that you comply with the above-mentioned terms prior to the Event.

You acknowledge that Stemette Futures does not provide insurance for fundraising activity or participation in the Event. You agree that you are responsible for securing appropriate insurance cover, if required for your fundraising activity or participation in the Event.

If you wish to withdraw your position prior to the Event, you must notify us as soon as possible, and in any case, at least 14 days before the Organiser’s registration deadline for the Event. Doing so will allow our team to reallocate your position to another applicant. If you withdraw after the registration deadline, we may decide to defer your place to the following year, at our sole discretion. In this case, any monies raised may roll-over and count towards your fundraising pledge for the following year.

  • Liability

To the extent permitted by law, Stemette Futures will not be liable for any damage or injury sustained by any person as a result of your participation or attendance of the Event, other than as a result of our negligence or as otherwise required under law.

  • Which Country’s Laws Apply to Any Disputes?

You agree that these Terms, their subject matter, and their formation, are governed by English law. We both agree that the courts of England and Wales will have exclusive jurisdiction. However, if you are a resident of Northern Ireland, you may also bring proceedings in Northern Ireland. If you are a resident of Scotland, you may also bring proceedings in Scotland.

  • Updates to these Terms

We reserve the right to change these Terms from time to time without notice prior to the Event by updating the version of the Terms on our website. You agree to any modifications made to these Terms after you submit your application form.
